These terms apply to all users of the service, including parents, guardians, and children using the service under parental supervision.

2. Description of Services

Real Santa provides AI-powered live video call experiences with a virtual Santa Claus. Our services include:

• Live video conversations with AI Santa
• Real-time visual recognition of toys, drawings, and pets
• Personalized conversations based on child profiles
• Optional call recording for family memories
• Parent dashboard for managing child profiles and call history

3. User Responsibilities

As a user of Real Santa, you agree to:

• Provide accurate information when creating accounts and child profiles
• Keep your account credentials confidential
• Use the services lawfully and in accordance with these terms
• Supervise children during video calls
• Not attempt to disrupt service integrity or security
• Comply with all applicable laws and regulations

4. Parent/Guardian Responsibility

Real Santa is designed for use by children under parental or guardian supervision. Parents and guardians are responsible for:

• Creating and managing their child's profile
• Providing accurate age information
• Supervising video calls with younger children
• Consenting to call recordings
• Managing and monitoring their child's use of the service

5. Intellectual Property

All intellectual property rights in Real Santa services, including software, designs, AI models, and content created by Idea Jet Lab, remain our property. You retain ownership of any recordings of your family's calls, which are provided for your personal, non-commercial use.

6. Payment Terms

Real Santa operates on a prepaid minutes model. Payment terms include:

• All purchases are processed securely through Stripe
• Purchased minutes do not expire within the Christmas season
• Prices are displayed in your local currency where available
• We reserve the right to modify pricing with reasonable notice

7. Refund Policy

Due to the real-time nature of our AI video call service and significant server costs:

• We cannot offer refunds on purchased minutes that have been used
• We offer a free 1-minute trial so you can test the service before purchasing
• If a technical error on our end disconnects your call, we will restore your minutes
• Contact support within 24 hours for any technical issues affecting your call

8. Recording Policy

Call recordings are available as an optional feature. By enabling recordings, you consent to your family's video call being recorded and stored. Recordings are:

• Stored securely and accessible only to your account
• Available for download for 90 days
• Not shared with third parties
• Not used for AI training purposes

9. Limitation of Liability

To the maximum extent permitted by law, Idea Jet Lab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities arising from your use of Real Santa services.

10. Disclaimer of Warranties

Real Santa services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure. However, we strive to provide a magical and reliable experience for all families.

11. Termination

We reserve the right to suspend or terminate your access to Real Santa services for violations of these terms, suspicious activity, or at our discretion. Upon termination, your right to use the service ceases immediately, though you may still access any recordings you've downloaded.

12. Governing Law

These terms are governed by the laws of Latvia. Any disputes arising from these terms or your use of Real Santa services shall be subject to the exclusive jurisdiction of the courts of Latvia. For EU consumers, this does not affect your statutory rights under local consumer protection laws.

13. Changes to Terms

We may modify these terms at any time. Changes become effective upon posting to our website. Continued use of Real Santa services after changes constitutes acceptance of the updated terms. We will notify users of material changes via email or in-app notification.
